The L-1A Visa: The Premier Tool for Your US Expansion

The L-1A Intracompany Transferee visa is specifically designed for high-level professionals like you. It provides two powerful pathways to bring your expertise to the United States.

01

Transfer to an Existing US Operation:
If your company already has a parent, subsidiary, branch, or affiliate office in the US, the L-1A allows you to transfer seamlessly into an executive or managerial role for an initial period of up to three years.

02

Establish a New Office in the US:

Don't have a US presence yet? The L-1A visa enables you to be the one to establish it. This is your opportunity to spearhead your company's expansion into the American market, with an initial visa period of one year to get your new office up and running.

03

The Ultimate Goal: A Path to Permanent Residency

Crucially, the L-1A is a dual-intent visa, meaning it is one of the most respected and direct routes to applying for a Green Card and securing permanent residency in the United States.

Do You and Your Business Qualify?

For Your Business (The Petitioner):

✅ A Qualifying Relationship: Your South African business must be linked to the US office as a parent, subsidiary, branch, or affiliate.

✅ Actively Doing Business: You must be actively and continuously providing goods or services in both South Africa and the USA for the duration of your stay. The mere presence of an agent or office is not sufficient.

For You (The Executive or Manager):

✅ One Year of Service: You must have worked for the South African company continuously for at least one year within the last three years.

✅ Executive or Managerial Role: You must be coming to the US to perform in a high-level capacity.

Executive Capacity means you make major decisions with broad latitude and minimal oversight.

Managerial Capacity means you supervise professionals, manage the entire organization or a key department, or manage an essential function at a high level.

Secure a Bright Future For Your Entire Family

The L-1A visa isn't just about your career; it's about your family's future.

Your spouse and unmarried children under 21 can accompany you under the L-2 visa classification. They are typically granted the same period of stay as you are.

More importantly, your spouse has the opportunity to apply for their own work authorization (EAD). This empowers them to pursue their own career, start a business, or work anywhere in the US without restriction, offering your family true freedom and flexibility.
